Do You Need Ownership Papers to Sell a Scrap Car in Manitoba?

Short answer: you need acceptable proof that you are entitled to sell the vehicle. In Manitoba, people often say "title," but the document used for an ordinary transfer is usually the Transfer of Ownership Document on the registration card.

What the Transfer of Ownership Document proves

MPI explains that the TOD gives reasonable assurance that the seller is the rightful owner. It also shows vehicle-status and inspection information and records the odometer statement. For a normal sale, the seller fills in the date and odometer reading and signs; the purchaser signs as well. The seller keeps the registration portion and gives the TOD portion to the purchaser.

What if the vehicle is no longer registered?

An old vehicle may have been parked after its registration expired. MPI says an Ownership Document can be provided on request for an unregistered vehicle. That is different from assuming no paperwork is needed. Ask an Autopac agent to check the record and tell you which document can be issued.

A bill of sale does a different job

MPI's buying and selling guidance says a private seller and buyer complete both the TOD and signed bills of sale. The bill of sale describes the year, make, model, serial number and agreed price. It records the transaction, while the TOD supports the ownership transfer. One should not be casually treated as a substitute for the other.

Cases that need an extra check

• The registration is in another person's name.
• The owner has died and the vehicle belongs to an estate.
• A bank or other creditor may have a lien.
• The VIN on the vehicle and paperwork do not match.
• The vehicle came from outside Manitoba.

You can still discuss the vehicle if the paperwork is incomplete, but the sale cannot be treated as ready until the ownership question is resolved. Also provide the vehicle's condition, keys, wheels, exact location and pickup access.
